Florida 559.920(17): offers for a claim

Florida Statutes 559.920 lists acts that are unlawful for a motor vehicle repair shop or its employee. Subsection (17) is: "Offer to a customer a rebate, gift, gift card, cash, coupon, or any other thing of value in exchange for making an insurance claim for motor vehicle glass replacement or repair, including, but not limited to, calibration or recalibration of an advanced driver assistance system. A nonemployee who is compensated for the solicitation of insurance claims is also prohibited from making such offer."

Florida 559.920(18): calibration notice

Subsection (18) makes it unlawful to fail to provide "electronic notice or written notice in at least 12-point type to the customer whether the calibration or recalibration of the advanced driver assistance system is required as part of the replacement or repair of motor vehicle glass".

Florida 627.7289(1): signing over benefits

Florida Statutes 627.7289(1) says: "A policyholder or any other person may not enter into an assignment agreement of post-loss benefits for motor vehicle glass replacement or repair" under a policy "issued or renewed in this state by an authorized insurer on or after July 1, 2023." It says: "Any such assignment agreement entered into in violation of this subsection is void and unenforceable."

Florida 627.7291: choice of shop

Florida Statutes 627.7291(1) says a person, including an insurer, agent, adjuster, or anyone acting on their behalf, "may not require a claimant to use a particular company or location" for windshield glass replacement, repair, or calibration under a personal lines automobile insurance policy. Subsection (2) says they "may provide an explanation of motor vehicle comprehensive coverage benefits and any applicable limit of liability to a claimant."

FAQ

This page is about Florida only. Some states restrict offers of cash, gifts, or other incentives for filing a glass claim, and some restrict signing over your insurance benefits to a shop. Be cautious of any such offer, and ask your insurer.
No. Glass coverage depends on your policy. Read your policy and ask your insurer or agent what it covers, what your deductible is, and how a claim could affect you.

General information only. We are not a glass shop, insurer, or agent, and we do not schedule, quote, or refer. Whether your policy covers glass damage, and what you would pay, depend on your policy and your insurer; read your policy and ask your insurer or agent. If your vehicle has driver assistance features, follow your vehicle maker's instructions and owner's manual on any calibration after glass work.
